AI FIRST COMPUTER IN A COMPUTER
TERMS OF USE AND END-USER LICENSE AGREEMENT

1. AGREEMENT

These Terms of Use and End-User License Agreement ("Terms") are a legal
agreement between you and the Application Provider.

If you obtained AI First Computer in a Computer ("the App") through Apple's
App Store, these Terms are concluded between you and the Application
Provider only, and not with Apple. The Application Provider, not Apple, is
solely responsible for the App and its content, except to the extent
applicable law or Apple's standard App Store terms provide otherwise.

By downloading, installing, accessing, or using the App, you agree to these
Terms. If you do not agree, do not use the App.

2. LICENSE

The App is licensed, not sold. Subject to these Terms and Apple's usage
rules, the Application Provider grants you a personal, non-exclusive,
non-transferable, revocable license to install and use the App on
Apple-branded devices that you own or control, including Family Sharing
where applicable.

You may not: copy, rent, lease, sublicense, or resell the App except where
allowed by law; reverse engineer, decompile, or disassemble it except where
that restriction is prohibited by law; remove proprietary or license
notices; or use the App in breach of these Terms, applicable law, or the
third-party license restrictions described in Section 6.

3. WHAT THE APP DOES

The App runs a complete Linux desktop as a virtual machine on your Mac,
using Apple's Virtualization framework. The Linux desktop includes
open-source software and third-party AI command-line tools. You have full
administrative ("root") access inside the Linux desktop.

4. YOUR RESPONSIBILITIES

Inside the Linux desktop you can install software, run commands, and change
or delete anything. The sandbox is designed to protect your Mac, but within
the Linux desktop you are solely responsible for what you and any AI tool
acting on your behalf do, including any data loss, cost, or damage that
results. You are responsible for complying with the laws that apply to you
and with the terms of any third-party service you access.

You must not use the App for anything unlawful, or to infringe others'
rights, or in violation of the terms of the AI providers or other services
you connect to.

5. DATA AND PERSISTENCE

Your home folder inside the Linux desktop is kept across app updates.
Everything outside your home folder is part of the system and may be
replaced when the App updates its Linux system. Factory Reset erases
everything. This is explained in full in the "How Your Data Is Kept"
document, which forms part of these Terms.

You are responsible for keeping your own copies of anything important. To
the maximum extent permitted by law, the Application Provider is not
responsible or liable for any loss of, or inability to recover, data or
settings caused by an app update, by replacement or reset of the Linux
system, by Factory Reset, or by anything you or an AI tool does inside the
Linux desktop. Keeping your work in your home folder and copying important
files onto your Mac is the way to keep them safe.

6. THIRD-PARTY SOFTWARE, AI TOOLS, AND OPEN-SOURCE LICENSES

The Linux desktop is built on open-source software (including a Linux
distribution based on Ubuntu, the XFCE desktop, the Chromium browser, and
many other packages) and includes third-party AI command-line tools. Each
of these is provided under its own license, listed in the "Third-Party
Notices" document, which forms part of these Terms. Your use of that
software is also governed by those licenses.

The AI tools connect to third-party services using your own accounts or API
keys. Those services are governed by the provider's own terms and privacy
policies, not by these Terms. The Application Provider is not responsible
for third-party software or services or for their output.

The App is not affiliated with, endorsed by, or sponsored by Canonical Ltd.
(Ubuntu), Google, OpenAI, Anthropic, Xiaomi, or Apple. Product names and
trademarks are the property of their respective owners and are used only to
identify the software they refer to.

OPEN-SOURCE COMPONENTS: DIRECT GRANT AND NO ADDED RESTRICTIONS

The Linux image is separate open-source software that is merely aggregated
with the App. Your rights to it come from its own licenses, and the
Application Provider grants you those rights directly and irrevocably.

Sections 2 and 4 of these Terms, and any term imposed by a distribution
channel through which you obtained the App, including any app store, apply
to the App only. To the extent any such term would restrict what the GNU
General Public License, the GNU Lesser General Public License, or any other
license of a component of the Linux image permits you to do with that
component, that restriction does not apply to that component, and this
direct grant governs it. The Application Provider imposes
no further restriction on your exercise of the rights those licenses give
you.

You have full administrative ("root") access inside the Linux desktop and
may modify, rebuild or replace any component of it. Nothing in the App
restricts or verifies what you run inside the Linux desktop.

The corresponding source for those components is available. See the
"Third-Party Notices" document for the source repository, the written offer
valid for at least three years, and how to obtain a copy of the Linux image
outside any app store, free of any app store terms.

7. SUBSCRIPTION AND FREE PERIOD

The App is free to use for the first 3 months. To continue using it after
the free period, the auto-renewing subscription "AIFCC Yearly" - a term of
1 year at EUR 49 (or the equivalent shown in your local currency at
purchase) - is required.

The subscription automatically renews for successive one-year periods
unless you cancel at least 24 hours before the end of the current period.
Payment is charged to your Apple Account at confirmation of purchase and on
each renewal. You can manage or cancel your subscription in your Apple
Account settings. The price shown in the App at the time of purchase
applies. Uncancelled subscriptions continue until cancelled.

8. NO WARRANTY

To the maximum extent permitted by law, the App and all bundled software are
provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether
express or implied, including fitness for a particular purpose, accuracy, and
non-infringement. The Application Provider does not warrant that the App or
any AI output will be uninterrupted, error-free, accurate, or safe. Some
jurisdictions do not allow the exclusion of certain warranties, so parts of
this section may not apply to you.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Application Provider is not
liable for any indirect, incidental, special, consequential, or punitive
damages, or for any loss of data, profits, or business, arising from your
use of the App, the Linux desktop, the bundled software, or any AI output.
Nothing in these Terms limits liability that cannot be limited by law
(including for death or personal injury caused by negligence, or fraud).

10. APPLE-SPECIFIC TERMS

You and the Application Provider acknowledge that Apple has no obligation to
provide maintenance or support for the App; that Apple is not responsible
for any product warranties, whether or not honored by the Application
Provider; that Apple is not responsible for addressing any claims by you or
a third party relating to the App; and that Apple and its subsidiaries are
third-party beneficiaries of these Terms and may enforce them against you.

11. CHANGES

The Application Provider may update these Terms. Material changes will be
presented to you in the App, and continued use after such changes means you
accept the updated Terms.

12. GOVERNING LAW

These Terms are governed by the laws of Austria, without regard to conflict
of laws rules, and subject to any mandatory consumer-protection rights of
your country of residence. Nothing here removes rights that applicable law
gives you as a consumer.
